The Regulatory Reform (Fire Safety) Order 2005 came into effect on 01 October 2006. This order relates to fire risk management in all businesses. It is possibly the most radical change in fire legislation ever. It places the sole responsibility for fire safety onto employers.
Responsibility for enforcement of the new rules will be with the local fire and rescue service authority who will carry out regular inspections with top priority going to those premises presenting most risk to the community.

Fire Risk AssessmentWhat action needs to be taken
 

A Fire Risk Assessment on your premises MUST be carried out and documented by a responsible, competent* person. The Fire Authority is the enforcing authority and failure to produce a written fire risk assessment where 5 or more persons are employed, constitutes an offence under the Workplace Regulations.

*A competent person should have an understanding of the systems/processes involved in relation to fire risk assessment, have an appreciation of fire safety, and be aware of the fire evacuation strategy.

Fire certificates no longer have legal status – you must have a Fire Risk Assessment and if you have five of more employees there must be a record of the fire risk assessment together with details of any people that are at particular risk.

  • You can do it yourself provided you are competent*
